Distance Contract
1. Contracting Parties This contract is concluded between:Seller: VENTA Event LLC, registration number 40103802327, VAT number LV40103802327, Sturisa street 23-1, Riga, Latvia, email: [email protected], phone: +371 28699990.
Buyer: Any natural or legal person making a purchase in the online store www.meilandsracing.com, hereinafter referred to as the “Buyer.”
2. Subject of the Contract
This contract defines the rights and obligations of the Seller and the Buyer, the procedure for purchasing and delivering goods, as well as the terms of product returns and warranty service.
3. Conclusion of the Distance Contract
The contract between the Buyer and the Seller enters into force when the Buyer places an order in the online store and receives the Seller’s confirmation of order acceptance. The Seller's confirmation is sent to the email address specified by the Buyer.
4. Price of Goods and Payment
4.1. The prices of goods are indicated including value-added tax (VAT).
4.2. The Buyer may pay for the goods using the payment methods offered in the online store (bank transfer, bank card, etc.).
4.3. Payment Processing and Security
Payments are processed by EveryPay, a certified payment service provider that complies with PCI-DSS security standards. All transactions are secured using SSL encryption and Mastercard SecureCode (3D Secure) technology to ensure data protection. Sensitive payment data is not stored on the Seller’s server.
4.4. Refund Procedure
If the Buyer exercises the right of withdrawal, the refund will be made using the same payment method as the original transaction. The refund process may take up to 14 days after the returned goods are received and inspected.
5. Delivery and Delivery Terms
5.1. Free Worldwide Shipping: We offer free worldwide shipping on all orders. The goods will be delivered to the address specified by the Buyer, within the time period mentioned in the product description. Please note that delivery times may vary depending on the product.
5.2. Additional Costs: While shipping is free of charge, the Buyer is responsible for covering any additional costs that may arise, including but not limited to customs duties, VAT, or any other tariffs and import taxes that may be applicable in the Buyer’s country. These fees are not included in the purchase price and are the responsibility of the Buyer.
5.3. Delivery Times for Made-to-Order Products: Many of the products in our store are made-to-order. As such, the exact delivery time for each product may vary. We recommend that the Buyer refers to the specific product page for the estimated delivery time of each item. Once we receive the product from the manufacturer, we will ship it out within 2 business days.
5.4. Delivery Service Providers: All orders are shipped securely via DHL or UPS, ensuring fast and reliable delivery. The Seller guarantees timely delivery within the specified period, but is not responsible for delays caused by circumstances beyond the Seller’s control, such as force majeure.
6. Right of Withdrawal and Product Returns
6.1. The Buyer has the right to withdraw from the distance contract within 14 days from the delivery date without giving any reason.
6.2. In case of product return, the Buyer must cover the direct return costs unless the Seller agrees to bear these costs.
6.3. The Buyer is obliged to return the product to the Seller within 7 days after sending the withdrawal letter.
6.4. The withdrawal letter in free form must be sent to the company’s email [email protected] or submitted via the contact form available on the website www.meilandsracing.com under the 'Contacts' section. The letter or message must include the purchase document number and date.
6.5. The Buyer cannot exercise the right of withdrawal if:
The ordered goods cannot be returned due to their nature, they perish quickly, or they are quickly consumable.
The ordered goods have been manufactured specifically for the Buyer based on an individual order.
The Buyer has opened the packaging of a product that cannot be returned due to health and hygiene considerations.
6.6. The Seller reserves the right to refuse the Buyer’s withdrawal request or withhold a compensation fee if the product is damaged, used carelessly, or handled contrary to instructions, or if the original packaging is lost or significantly damaged.
7. Warranty and Product Quality Responsibility
7.1. The Seller guarantees that all goods are of high quality and comply with all regulatory requirements of the Republic of Latvia.
7.2. The warranty period is 2 (two) years from the date of product delivery.
8.1. All disputes arising in connection with this contract shall be resolved through negotiations. If the dispute cannot be resolved through negotiations, it will be settled in accordance with the regulatory acts of the Republic of Latvia.
8.2. This contract is drafted and interpreted in accordance with the laws of the Republic of Latvia.
9. Affiliate Program Terms
9.1. The Seller offers an affiliate referral program that allows individuals (hereinafter referred to as “Partners”) to earn a commission by referring customers to the online store www.meilandsracing.com using unique referral codes.
9.2. Each Partner is assigned a unique referral code. When a Buyer makes a purchase using the referral code, the Partner earns a commission in the amount of 5% of the net order value (excluding VAT).
9.3. The commission is calculated monthly based on completed and paid orders that are not returned or cancelled. Orders that are returned, cancelled, or refunded are excluded from commission calculations.
9.4. Commission payments are made once per month, no later than on the 10th business day of the following month. Payments are made via bank transfer or PayPal, based on the Partner’s chosen payment method.
9.5. The minimum payout threshold is EUR 20. If the total commission for a given month is below this amount, it is carried over to the next month until the threshold is reached.
9.6. The Partner is responsible for providing accurate payment details and ensuring compliance with applicable tax laws. The Seller shall not be held liable for any delays or issues caused by incorrect payment information or tax reporting obligations.
9.7. The Seller reserves the right to withhold or revoke commissions in cases of fraudulent activity, abuse of the referral program, or violation of these Terms and Conditions.
9.8. Participation in the affiliate program is voluntary and may be terminated by either party at any time, with or without notice. Upon termination, no further commissions will be earned, and outstanding amounts below the minimum payout threshold will not be paid.
10. Privacy Policy
10.1. The Seller collects and processes personal data in accordance with the General Data Protection Regulation (GDPR) and other applicable laws of the Republic of Latvia.
10.2. Personal data collected during the purchase process (such as name, address, email, and payment details) are used solely for order processing and delivery.
10.3. The Buyer’s personal data will not be shared with third parties except when required for payment processing (via EveryPay) or delivery (via DHL or UPS).
10.4. The Buyer has the right to request access, correction, or deletion of personal data by contacting the Seller at [email protected].
